1. General
These Terms & Conditions ("Terms") govern your use of the website https://bvdart.nl and any purchases made through it. By accessing the website or placing an order, you agree to these Terms.
BVDART is operated from the Netherlands by Berend van Dijk.

2. Products
2.1 Limited-Edition Prints
We sell signed and numbered limited-edition giclée prints. Each edition has a fixed size. Key details:
- Printed on Hahnemühle Photo Rag 308 gsm archival paper
- Includes a certificate of authenticity
- Edition size and remaining availability are listed per artwork
Product images are representative. Minor colour variations may occur due to screen calibration and printing processes.

2.2 On-Demand Reproductions
Selected artworks are available as on-demand reproductions via Werk aan de Muur (WadM). These products — including canvas, metal, and acrylic prints — are manufactured and shipped directly by WadM. Purchases of WadM products are governed by WadM's own terms and conditions.

3. Prices & Payment
- All prices are listed in euros (€) and include VAT where applicable.- Applicable VAT is calculated automatically at checkout based on your location.- Payment is processed securely via Stripe. Accepted methods include credit/debit card, iDEAL, and Bancontact.- An order is confirmed only after successful payment.

4. Shipping
Limited-edition prints ship from the Netherlands. Estimated dispatch within 3–5 business days after order confirmation. Shipping rates and estimated delivery times vary by destination:
- Netherlands (NL) — €6.95, 1–3 business days- Belgium, Germany, Luxembourg (BE, DE, LU) — €9.95, 2–5 business days- Western Europe (FR, AT, DK, PL, CZ) — €14.95, 3–7 business days- Wider Europe & UK (IT, ES, PT, SE, NO, FI, IE, CH, GB) — €19.95, 5–10 business days- Rest of World (US, CA, AU, JP) — €29.95, 7–14 business days
Additional items in the same order: +50% of the base shipping rate per extra item.
Delivery times are estimates and not guaranteed. We are not liable for delays caused by carriers or customs processing.

5. Returns & Refunds
5.1 Limited-Edition Prints
You have the right to return your order within 14 days of receiving it, in accordance with Dutch and EU consumer protection law (right of withdrawal).
To initiate a return, email us at berend@bvdart.nl within the 14-day period. The print must be returned in its original condition and packaging. Return shipping costs are at the buyer's expense.

Once we receive and inspect the return, we will issue a full refund via the original payment method within 14 days.
We cannot accept returns of prints that are damaged due to mishandling by the buyer.

5.2 On-Demand Reproductions (Werk aan de Muur)
Products purchased through Werk aan de Muur are subject to WadM's return policy, which includes 100-day free returns. Please contact WadM directly for return requests on those products.

6. Intellectual Property
All artworks, images, code, and content on this website are the intellectual property of BVDART / Berend van Dijk, unless explicitly stated otherwise.
- Purchasing a print gives you ownership of the physical object, not the underlying copyright.
- You may not reproduce, distribute, or commercially use any artwork without prior written permission.
- Personal, non-commercial sharing (e.g. photos of the print in your home) is encouraged.

7. Use of the Website
You agree to use the website only for lawful purposes. You may not:
- Attempt to gain unauthorised access to any part of the website or its systems
- Use automated tools to scrape, copy, or download content with the intention of plagiarism
- Interfere with the website's operation or other users' access

8. Limitation of Liability
To the fullest extent permitted by law:
- BVDART is not liable for indirect, incidental, or consequential damages arising from the use of this website or the purchase of products.
- Our total liability for any claim related to an order shall not exceed the amount you paid for that order.
- We are not responsible for colour differences between screen display and printed output.

9. Force Majeure
We are not liable for failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, strikes, shipping disruptions, pandemics, or government actions.

10. Applicable Law & Disputes
These Terms are governed by the laws of the Netherlands. Any disputes will be submitted to the competent court in the Netherlands.
For EU consumers: you may also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

11. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes take effect upon publication on this website. Continued use of the website after changes constitutes acceptance.
